House Bill 23-1105 Task Forces To Examine Issues Affecting Homeowners’ Rights In Colorado

House Bill 23-1105 passed and became law on May 24, 2023. It creates two task forces, one that focuses on HOA homeowners’ rights and a second task force focusing on Metropolitan District homeowners’ rights. The Department of Regulatory Agencies (“DORA”) is excited to share an opportunity with you to participate. Participation can take many forms, but right now, we are most interested in individuals that would like to be appointed to one of the Task Forces. The Task Forces will meet several times over the next few months and each will prepare a report to be presented to the Colorado General Assembly, the Governor’s Office, and the public.

HOA Homeowners’ Rights Task Force Member Application

DORA is creating a special task force to look at issues confronting Common Interest Communities (“CICs”) in Colorado which include HOAs, POAs, condominiums, cooperatives, recreational associations, timeshares, and other associations. In Colorado, most CICs are subject to the Colorado Common Interest Ownership Act (“CCIOA”).

There are two different appointing authorities for the HOA Task Force, so if you believe that you satisfy the requirements set forth below to serve on the Task Force, please submit an application to the proper body as discussed below.

The following Task Force members will be appointed by the Chair of the Colorado House of Representatives:

  • Two HOA Homeowners:
    • At least one whom resides in a CIC in a Disproportionately Impacted Community, as defined in section 24-4-109(2)(b)(II), C.R.S.
    • At least one whom serves on the executive board.
  • A representative of an organization that advocates for HOA Homeowners in Colorado.
  • A Colorado attorney who specializes in representing homeowners in legal matters against CICs.

HOA Task Force General Assembly Appointment Application

The Office of the Governor is the second appointing authority. The following Task Force members will be appointed by the Governor:

  • A Colorado attorney specializing in CIC law.
  • A representative of a Developer registered pursuant to section 12-10-503(1), C.R.S.
  • An accredited Community Association Manager (“CAM”).

If you are interested in any of these positions appointed by the Governor, please submit an application at the following link before July 1, 2023.

HOA Task Force Governor Appointment Application

Metropolitan District Homeowners’ Rights Task Force Member Application

Like the HOA Homeowners’ Rights Task Force, there are two appointing authorities for the Metropolitan District Homeowners’ Rights Task Force.

The following Task Force members will be appointed by the Chair of the Colorado House of Representatives:

  • Two Homeowners residing in a metropolitan district:
    • At least one of which resides in a metropolitan district located in a Disproportionately Impacted Community
    • At least one of which serves on the board of the metropolitan district in which the homeowner resides.
  • An elected city council member, as recommended by a statewide organization that represents municipalities.
  • Licensed Colorado attorney who primarily represents homeowners in legal proceedings against metropolitan districts.
  • A representative of a nonprofit organization that represents the affordable housing community.

Metro District Task Force General Assembly Application

The Office of the Governor is the second appointing authority. The following Task Force members will be appointed by the Governor:

  • Licensed Colorado attorney specializing in metropolitan district law, as recommended by a statewide organization that represents special districts.
  • An elected county commissioner, as recommended by a statewide organization that represents counties.
  • A representative of a Developer registered pursuant to 12-10-503(1) with one or more subdivisions in a metro district.
  • A representative recommended by a statewide nonprofit organization that represents metropolitan district education in a coalition.
